**GENERAL TERMS AND CONDITIONS OF LECLIC FOTOGRAFIE**

**1. General Provisions**
1.1 The following General Terms and Conditions (GTC) apply to all orders placed with LeClic Fotografie. They are considered agreed upon unless immediately contested.

1.2 “Photographs” in the context of these GTC include all products created by LeClic Fotografie, regardless of the technical form or medium in which they were created or are present (e.g., prints, still-videos, electronic image files, videos).

1.3 These GTC are deemed fully accepted upon the client placing an order with LeClic Fotografie. The client waives the use of their own contractual terms, which only become binding if LeClic Fotografie expressly confirms them in writing. Ancillary agreements are only effective if expressly confirmed.

1.4 The client undertakes to carefully read and fully acknowledge these GTC.

**2. Copyright**
2.1 LeClic Fotografie transfers a simple usage right to the client under the condition precedent of payment of the agreed fee. Usage rights are granted only upon full payment of the fee.

2.2 When using the photographs, it is up to the client to name LeClic Fotografie as the author of the image. LeClic Fotografie waives claims for damages due to violation of the right to name attribution.

2.3 If the usage rights are transferred according to clause 2.1, LeClic Fotografie will provide the image files to the client.

**3. Fees, Retention of Title**
3.1 A fee will be charged for the creation of photographs, based on hourly, daily rates, or as a fixed fee. Additional costs such as travel expenses, model fees, props, and material costs are to be borne by the client. Travel up to 30 km is included; every additional kilometer is charged at €0.30.

3.2 Invoices are payable within 7 days without deduction. The client is in default if they do not settle due invoices within 21 days of receipt.

3.3 Until the agreed fee is paid in full, delivered photographs remain the property of LeClic Fotografie. Any rights transferred remain with LeClic Fotografie until payment completion.

**4. Liability**
4.1 LeClic Fotografie is liable only for intent and gross negligence concerning obligations not directly related to essential contractual duties. Liability also extends to damages caused by breaches of life, body, or health obligations by LeClic Fotografie or its agents.

4.2 LeClic Fotografie is only liable for technical defects, such as failures of camera or light technology, when due to intent or gross negligence. Liability is limited to the agreed fee.

**5. Additional Duties**
5.1 The client warrants that they hold rights to all provided templates and images, including permissions from depicted individuals.

**6. Service Disruptions and Cancellation Fees**
6.1 If order fulfillment time is exceeded for reasons beyond LeClic Fotografie’s control, fees may be adjusted.

6.2 Confirmed delivery dates are binding only if expressly confirmed.

6.3 Client cancellations are charged based on notice timeframes, with varying percentages of the total fee.

**7. Data Protection**
7.1 Personal data required for business transactions may be stored.

**8. Digital Photographs**
8.1 Any modification, storage, or reproduction requires LeClic Fotografie’s prior written approval.

**9. Final Provisions**
9.1 Place of performance and jurisdiction is Gernsbach.
